UPDATE: Renton Police Department Struggles With Morale, Personnel Issues

Internal investigations have led to discipline, and now the city is pursuing the anonymous maker of cartoon videos that made fun of police department and city gaffes.

The Renton Police Department is reeling from what the chief calls "unprecedented" personnel issues that have led to multiple internal reviews, disciplinary action against supervisors and now a legal hunt to find out who created a series of video parodies about the department.

An internal investigation earlier this year found that Deputy Chief Tim Troxel demonstrated “unbecoming conduct” for asking an on-duty officer to help him stake out the home of his then-girlfriend, also a city employee, whom he suspected of having a relationship with someone else.

Troxel acknowledged his actions in the 2009 incident, according to the review, which started in November 2010. His initial proposed discipline of a 40-hour suspension without pay was reduced to 24 hours without pay when it was finalized in February. Troxel has been with the department since 1984 and was promoted to deputy chief in 2007.

Another pending internal investigation involves Charles Marsalisi, a deputy chief who was recently demoted to sergeant over his role in or knowledge of a collection of cartoon videos parodying the department and city employees. Police Chief Kevin Milosevich confirmed the demotion to Patch in an interview late last month.

The city attorney’s office is trying to find out who made the videos, claiming that they constitute cyberstalking, according to an affidavit for a search warrant first reported Thursday by kirotv.com. (KIRO's story and some of the cartoons are here.)

The city claims that three city employees felt they were “targeted by embarrassing and emotionally tormenting comments about past sexual relationships or dating relationships that were discussed within some of these videos,” according to the affidavit. The affidavit is seeking information related to a Gmail account linked to the videos.

Questions about the legal action were referred to the city's Chief Administrative Officer Jay Covington, who didn't return phone messages left Thursday.

One other internal investigation is also ongoing, with a due process hearing for Sgt. Bill Judd held Thursday. Details about that investigation weren’t available.

Although Chief Milosevich said that it's department policy not to comment on personnel issues, he provided some insight into the weight of the situation in a conversation with Patch in late July.

"It's unprecedented, some of these issues," he said in regard to the disciplinary actions involving Troxel and Marsalisi.

"I don't think you can go through disciplinary actions of two deputy chiefs and not have it affect morale," he said.

An anonymous letter, which appears to be from a longtime police department employee, sent to the mayor in November calls the issues "JUST the tip of the iceberg."

“Moral [sic] will continue to decline, you will start to have rouge [sic] cops become more prevalent because that is their example above them,” the letter said. “If you do nothing, then that is on you. But at least I said something. I’ve seen too much not too [sic].”

Milosevich said that higher-ranking personnel have ongoing supervisory training to assist them with their positions and the leadership duties and responsibilities of their positions.

"When you agree to serve in a public capacity, you'll be held to a higher standard," he said, adding that that's the reason the department must now be open about the issues.

"We have to air our dirty laundry."

Kirotv.com has reported that the City of Renton filed an affidavit for search warrant with King County Superior court last week in order to uncover the name of a video cartoonist who created parodies of the department.

While the city is taking issue with the second set of cartoons, which were posted in April, First Amendment rights advocates quoted by Kiro say the move is an "extreme abuse of power."

The city does not plan to take legal action over the first set of cartoons that were posted in January, and let to an internal investigation, said a department official.

The cartoonist is just one problem in the Renton Police Department.

Another recent personnel issue involves Deputy Chief Tim Troxel for 'unbecoming conduct' and 'abuse of position' for asking subordinate officers to assist him with stalking his then girlfriend, also a City of Renton employee. Troxel has been with the department since 1984.

Yikes. If the police can't deal with a good public flogging and freedom of speech, what else can't they deal with? The only thing that will be gained from this legal action is material for a couple more cartoon characters.

What scares me is what we don't know and how much daily is 'under rug swept'. I've always been afraid of the police; I believe they've given me just reasons. Renton is tanking quicker than the stock market.

The fact that Mr. Troxel is still a Deputy Chief after stalking a woman in Newcastle to see if she was seeing another man and the fact that he took two different subordinates on two different occasions to check on this person bothers me very much. He has been in the police force for 27 years and knew what he was doing was more than just a bad judgment call on his part and so does Chief Milosevich as well as every Renton policeperson. Deputy Chief Troxel keeps his rank with 24 hours without pay for his illegal actions. Other policepersons have received demotions for knowing about the cyber cartoons. How Chief Milosevich maintain morale among the police force when Deputy Chief Troxel is left in a position of authority which he misused by having two subordinates accompany him on his foray into Newcastle to spy on a person? Troxel says he owned up to what he did and now he and "everyone else" want to move on. I bet! Wonder what would happen if citizens that are arrested just owned up to their crime? Would it make the difference it did for Troxel? My guess is no.

This incident shines a light on common, regular police behavior. Cops lie, cops cheat, cops kill. Then they try to cover it up. I've observed this up close way too many times, known many people who have been on the receiving end of police misconduct, brutality, etc, including myself.

Hah should have guessed Sandra Meyer works for the City of Renton. She's a Transportation Systems Director. I've already put up two videos making fun of the chief and the prosecutor. Maybe someone should be looking into your department as well Sandra.

Sandra Meyer USED TO work for Renton, and a more decent human being you will never find. Mrs meyer's only fault is naivity, but her ethics are what anyone would want a a city employee. You are so off base here in your acusations it is dumb. Milo is the police cheif, but Denis Law is mayor and chief Milo serves at the Mayor's pleasure, as does the prosecutor who brought this case to the judge after shopping around for a prosecutor and being turned down by at least one who would. Take a look at what KIRO has uncovered. In a nut shell Sandra Meyer was replaced because she did not just implement what the Mayor had dirrected regardless, after being told to do so by the council but mayor Law had "the Council's backing when he ran for mayor, as well as the Police Guild. Not all on the Council are fans of the Mayor, but he still has a majority on the Council who support him and his rotten ways.Mrs Meyer was qualified to hold the position she held, and she only did what she thought was best for all of Renton. Her loyalty to chief Milo should tell you something. He is not a bad guy, but if Milo have defied the Mayor Renton would have had a much worse Police Chief. Milo is the Police Chief, but decisions like this one did not originate with him. He either does what the Mayor wants or he would have been replaced with someone who would do everything the mayor wants. Mayor Law is a bully, he is used to getting his way and when someone stands in the way of

OverAndOut even if that's true, Milosivich has a sworn duty to uphold the law, regardless of what the mayor says. This just makes him look spineless if true. It's still abuse of office anyway you spin it.

For the record, my personal reasons for leaving the City of Renton are a little distorted here. No one made me leave, although I do appreciate the very kind words about my department, competence and character (soon to be followed by additional spit in my face regardless, by "Charlie"-no doubt).Also, I had a good relationship with the council there at the time. So, here is how it goes-Mayor Law is the CEO for the City and as such, has an obligation to investigate and vet all viable options in this situation with the CAO, legal counsel, and the chief. He may discuss it with the council in an Executive Session. One of those options may be to drop this-it depends on many factors. It is also a matter of public trust and confidence because people will believe these videos. You don't know if they are really true or convenient distortions.They certainly contain spiteful, and mean-spirited content, and that is bad for the city's overall image. We have a good police department-probably one of the better ones from what I've experienced. They deserve our respect.

They have no choice but to drop it, this doesn't even remotely qualify under the RCW as cyberstalking. Read the RCW. There were no threats in the videos. It was parody, protected under the constitution. Husler Magazine vs Falwell affirmed this by a 8-0 vote by scotus in 1988.

Yes, many people are involved in the evaluation but it will start with the attorneys.. It may all come down to nothing as Charlie states, but they will have to evaluate it anyway. The morale of the department may be the bigger issue since the videos are so negative.

A lawyer already evaluated it and filed for a search warrant. That is malicious prosecution under RCW 9.62.010 any first year law student knows this.

What the city prosecutor did wasn't just a civil rights violation, it's a crime, the chief of police is also guilty of this. The person that posted the video committed no crime.

Furthermore the officer that signed the affidavit makes the statement in it. "These videos appeared to reference the City of Renton and Renton Police Department located within the State of Washington." False no references to Renton were in the videos. Further down he states "This Officer did not mention a specific City or Police Department..." contradicting his first statement.

It will take years for the citizens of Renton to trust, believe, have faith in the Renton Police Department. I have lost all confidence in the running of our city. Currently we are in the worst economic crisis and now must waste tax money? I fear we will see law suits filed against the police deparment for every traffic stop, warrants served, DUI stops with people crying out against the police. Myself; I have always feared the police and have greater fear now. I am unsure how to correct the problem. I am sure some of the 'players' need to be fired. Demoted is a joke.

The mayor, police chief and council should all be replaced. Renton is a Banana Republic. None of these folks care about citizen input, be it traffic cameras, retaining the most beautiful library site in the country. or 24% water rate increase. Have youn ever seen the Renton Reporter question one thing these people put forward.. They all scratch each others back at our expense. Thanks, Jerry Koukal

Dear Chief and Mayor, if you want to reduce tension within the department, how about fix your relationships outside the department? Do you really want us to trust that you did everything correct? Then post the criminal investigation online. Show us that everything was done correctly, appropriately, and LEGALLY. Show us all the search warrants and reports and interviews. Anything other than that is pure smoke and mirrors.

And by way, friends of mine that work for a different police department thought the cartoons were about them, at least until Renton claimed them. I would suspect that the cartoon creator is considering a lawsuit, so maybe you should get your ducks in a row now. As a citizen, I don't have a clue as to force the department to be open and transparent, because only those with a badge are allowed to see the inner workings.
